Agreement to Our Legal Terms
Welcome to Sowparnika Projects & Infrastructure Pvt. Ltd. (“Company”, “we”, “us”, or “our”). We are located at: #750, 1st Main Rd, AECS Layout - C Block, Kundalahalli, Marathahalli, Bengaluru, Karnataka 560037, India. By accessing or using our website https://www.sowparnika.com/ ("Site") and related services (“Services”), you agree to abide by these Terms and Conditions (“Legal Terms”). If you do not agree, kindly refrain from using the Services.

1. Our Services
Our Services include property listings, project updates, online inquiries, and other related real estate services across Karnataka, Kerala, and Tamil Nadu.
2. Compliance with RERA
We comply with the Real Estate (Regulation and Development) Act, 2016 (“RERA”).
- RERA Registration: All projects will carry valid RERA registration numbers, and the information provided aligns with the RERA Act.
- Transparency: Project details, layouts, specifications, and timelines will be clearly communicated on our official website and RERA portal.
- Updates: Customers will be notified of changes in project timelines, approvals, or layouts as mandated under RERA.
Note: You can verify project details and approvals via the respective state RERA websites.
3. Property Descriptions and Accuracy
- All information provided (pricing, layouts, images) is accurate at the time of publication.
- We reserve the right to update details, including pricing and availability, to align with regulatory or project-specific changes.
- Final specifications will be as per the Sale Agreement signed between the buyer and Sowparnika.
- Customer Responsibility: It is your responsibility to verify project details through our representatives or RERA portals before any booking.
4. Intellectual Property Rights
- All content on our website (text, logos, designs, images) is our intellectual property or used under license.
- You are prohibited from reproducing, copying, or distributing any content without prior written consent from Sowparnika.
5. User Representations
By accessing the Services, you confirm that:
- You are at least 18 years of age and legally capable of entering contracts.
- All information you provide is true, accurate, and current.
- You will use the Services solely for lawful purposes.
6. Prohibited Activities
- Post inaccurate or misleading information.
- Violate any RERA provisions, laws, or regulations.
- Use automated tools to access or disrupt the Services.
- Use the Services for fraudulent purposes or spamming.
7. Data Privacy and Security
We comply with the Digital Personal Data Protection Act (DPDP), 2023.
- Data Collected: Name, contact information, property preferences, and payment details.
- Purpose: Collected data will be used for bookings, updates, and marketing communications (with user consent).
- Data Security: We employ encryption, firewalls, and access controls to protect your data.
- User Rights: You have the right to:
- Access your personal data.
- Request corrections or deletion of your data.
- Withdraw consent for data usage.
8. Cybersecurity Measures
- We adopt industry-standard security protocols to safeguard against hacking, malware, and unauthorized access.
- In case of a data breach, users will be notified within 72 hours as per applicable laws.
- User Guidelines: Do not share login credentials or sensitive data with unauthorized parties.
9. Payment, Booking, and Refund Policies
- Payment Terms: Payment schedules will align with the Sale Agreement.
- Refund Policy: Refunds for cancellations or delays will adhere to RERA regulations and the terms outlined in the Sale Agreement.
- Non-Refundable Fees: Certain fees, such as booking or administrative charges, may be non-refundable.
10. Force Majeure
- We will not be held liable for delays caused by events beyond our control, including but not limited to:
- Natural calamities (floods, earthquakes).
- Pandemics or government-imposed restrictions.
- Strikes, civil disturbances, or disruptions in supply chains.
11. Limitation of Liability
- Sowparnika’s liability is limited to the amount paid by the buyer within the last 3 months.
- We are not responsible for:
- Third-party breaches.
- Unauthorized access or tampering with user data.
- Delays caused by regulatory or unforeseen circumstances.
12. Grievance Redressal Mechanism
In compliance with RERA and IT Rules, we have appointed a Grievance Officer:
13. Dispute Resolution and Governing Law
- Any disputes will be resolved as per the Indian Arbitration and Conciliation Act, 1996.
- Seat of arbitration: Bangalore, Karnataka.
- Jurisdiction: Courts in Bangalore, India.
14. Third-Party Services
- We may recommend third-party services (e.g., banks, legal advisors). Sowparnika is not responsible for:
- The quality, accuracy, or reliability of third-party services.
- Any loss or damage caused by third-party actions.
15. General Provisions
- Severability: If any provision is found invalid, the remaining terms will remain enforceable.
- Waiver: Failure to enforce any provision does not constitute a waiver of our rights.
- Entire Agreement: These Terms constitute the entire agreement between you and Sowparnika.
Terms and Conditions: for the Campaign: "Ho Ho Homes"
1. This offer is valid exclusively for the Ather Rizta-S model.
2. The offer is valid from December 14, 2024, to January 5, 2025.
3. The offer is applicable only for bookings where the disbursement is completed within 30 days of booking.
4. The vehicle will be delivered within 15 working days from the date of the first disbursement.
5. Vehicle color options are subject to availability at the time of delivery.
6. Any upgrades to a higher model or additional accessories will be at the customer's expense.
7. The offer includes the vehicle’s on-road price, RTO registration, Smart Card Fee, and comprehensive insurance coverage (1 year for Own Damage + 5 years for Third-Party Liability, including add-ons).
